Nearly two years ago, 12-year old Sarah Nicole Perkins was hit by a boat on the Coralville Reservoir and killed. Her parents have decided to file a lawsuit against the operators of the boats two years after the death.
According to kcrg.com, the parents are filing a lawsuit for negligence on the part of the drivers of both boats, stating that they were driving their boats in a reckless manner that resulted in the death of their daughter.
According to the report from two years ago, Sarah Perkins and another girl were being pulled on an inner tube by Janyce Gray and her husband, Robert Gray. The Department of Natural Resources reported the incident that occurred.
Gray approached the "no wake" zone where another boat, driven by a man named James Zahorik had been sitting. When he turned his boat to leave, he increased his speed as both boaters turned.
Perkins fell from the tube and was hit by Zahorik's boat, dying in the collision. She was still in the water when the death occurred.
Although Perkins died, no charges were filed because too many factors were involved and Zahorik had not been drinking too much. Police ruled the incident as an accident, but two years later, that ruling is being challenged by Perkins' parents.
The incident happened on May 30, 2010 at around 7 p.m. and two years later, the parents have decided to file a suit to seek punishment for the boat drivers. The suit was filed this week.
